Effective September 1, 2024. This Notice describes how medical information may be used and disclosed and how you can get access to it.

HIPAA Notice of Privacy Practices

This Notice describes how medical information about you may be used and disclosed by Level Up Health, LLC in its capacity as a Business Associate to the affiliated medical professional company that takes care of you, and how you can get access to this information. Please review this Notice carefully.

What is your medical information?

Medical information includes all health care related information your healthcare provider and the company have in your file, including your medical history, current condition, diagnosis, examination notes, test results and prescriptions.

Why you are receiving this Notice

The company is a Business Associate to your healthcare provider and performs certain administrative functions that require access to your medical record. As a Business Associate, the company must comply with the HIPAA Privacy Rule, which requires the company to protect the confidentiality of your medical information. Your healthcare provider must also comply with the HIPAA Privacy Rule.

The Privacy Rule gives you certain rights with respect to your medical information. This Notice explains both our obligations and your rights under the Privacy Rule.

The company reserves the right to change its privacy practices and apply the changes to your medical information. If privacy practices change, a revised Notice will be mailed to the address you provided.

Uses and disclosures

Health care operations: The company maintains a comprehensive electronic health record system which your healthcare provider uses to access your medical record and add information to that record. The company uses information in the record to provide administrative and support services to your healthcare provider, track, locate and load lab test results, keep track of appointments and answer questions that do not require you to speak with your healthcare provider.

Payment: The company handles billing for laboratory tests prescribed by your healthcare provider, collects any amount due from you and makes sure payment is transmitted to the appropriate laboratory. Billing information, including backup sent with the bill, identifies you and includes information about the tests performed and your test results.

Business Associates: The company may use outside consultants, including financial, IT and legal consultants, who may need access to the electronic health record system while providing services. Before disclosing medical information to such consultants, the company requires the contractor to sign a Business Associate Agreement to protect confidentiality.

We may disclose your medical information as required by law, including workers' compensation regulations; to the Centers for Medicare and Medicaid Services or other regulatory agencies; in response to a court or administrative order or valid subpoena; for law enforcement or public health purposes; to governmental authorities if we believe you have been the victim of abuse, neglect or domestic violence; to a health oversight agency; to avert a serious threat to health or safety; in connection with specialized government functions; or during a medical emergency as necessary to protect your welfare.

The company will make other uses or disclosures of medical information not related to treatment, payment or health care operations only with your prior written authorization. You are not required to sign an authorization, and if you do, you may revoke it at any time.

We will contact you to provide appointment reminders only at the telephone numbers or email address you provide for that purpose.

Complaints

If you think your privacy rights have been violated, you may complain to the Compliance Director at the company and/or to the Secretary of Health and Human Services. To file a complaint with the company, please speak with the Privacy Officer, Joey Speers. The company will not retaliate against you for filing a complaint.

Your rights

Although your physical medical file belongs to your healthcare provider, the information in your file belongs to you. You have the right to request restrictions on use or disclosure of your medical information for treatment, payment and health care operations. Neither your healthcare provider nor the company has to agree to the requested restrictions, but if either agrees, they must abide by them.

You may request that your healthcare provider and the company use an alternative means to communicate with you on a confidential basis about your medical information, or send communications to an alternative location.

You may inspect and copy your medical information for as long as your healthcare provider and/or the company maintain your medical record. Under specific circumstances, your request may be denied, and in most cases that denial is reviewable. Some medical information is not available for access, including psychotherapy notes and information prepared in anticipation of civil, criminal or administrative proceedings.

You may request in writing that your healthcare provider and the company amend your medical information or record, unless the record is already accurate and complete or neither your healthcare provider nor the company created the information you wish to amend. The company will act on your written request within 60 days after receiving it and either make the amendment or provide a written denial.

Except for certain disclosures, you may request an accounting of disclosures of your medical information by both your healthcare provider and the company. You may also receive a paper copy of this Notice.

Company obligations

The company is required to maintain the privacy of your medical information and provide you with this Notice, abide by the terms of this Notice, notify you if it cannot agree to a use or disclosure restriction you request, and accommodate reasonable requests to communicate by alternative means or at an alternative location.
